Anna, 25 06084 Passo di Bettona (PG) P.IVA 03839350547 and owner of the following Domains: https ://europlantsvivai.com http://piantedafrutta.com Below are the terms and conditions of sale with which you can make simple online purchases of potted plants sold by us on the internet.

2. Orders

The Customer, after having identified the varieties and quantities of Plants he needs, can Add them to the Cart and proceed to Payment at the Cashier.
At the checkout, the next step will be to enter the information for the billing and shipping of the order, choose the payment method and send the order.
Euro Plants Vivai will reply via Email to the address indicated by the Customer, confirming the products and quantities requested.
In the event of stock exhaustion, Euro Plants Vivai, with the customer’s authorization, will replace the missing varieties with similar ones.
N.B. We update our Websites daily, making the Product “In Stock” or “Out of Stock”, trying to welcome the Online Customer as best as possible, putting your S.V. at ease to Buy Safely and Easily.

3. Prices

are to be considered VAT included (10%) and net of transport.

3.1 Transportation Costs

(Italy)
Transport costs are considered with a rate of € 10.00 per order. When an order exceeds € 100.00, transport is free.
(Europe)
Transport costs are considered with a rate of € 25.00 per order.

4. Payment

4.1 PayPal/Credit Card

Possibility to pay securely with PayPal. If you do not have a Paypal account, you can still pay by credit card. With PayPal Standard the Customer will be redirected to PayPal to make the payment.
The domains https://europlantsvivai.com and http://piantedafrutta.com have obtained the SSL (Secure Sockets Layer) certificate, allowing secure communication from source to recipient, distinguished by the POSITIVE SSL SECURED WEBSITE symbol.
The Euro Plants Vivai PayPal account is a verified account.

4.2 Bank Transfer

To speed up order preparation times, it is advisable to send an email to the address info@europlantsvivai.com of the accountant issued by the customer’s bank. However, the order will only be processed after the actual crediting of the sum.
Payment for the order must be made within 10 days of sending the Order Confirmation; after this deadline, the order will be automatically cancelled.

4.3 Marking

Surcharge for cash on delivery management of € 6.00.
Euro Plants Vivai offers its customers the opportunity to purchase securely via PayPal and bank transfer, saving the additional cost of € 6.00.
By clicking Cash on delivery, a € 6.00 supplement will be added to your shopping. Euro Plants Vivai will calculate the Supplement of € 6.00 when sending the goods.

5. Shipping

All plants are supplied with the producer’s identification tag and variety name.
Their appearance is specified on each Product Page with the measurement of the Height, the Age of the Plant and the diameter of the pot.
For reasons of size and packaging, the plants could be pruned before shipment.
There could also be some small breakage of the twigs during transport, not attributable to our will, which however do not compromise the engraftment of the same.
Depending on the type, the products are packed in cartons or on pallets, with triple-layer protective cardboard, fastening strings and our company’s customized adhesive tape.
Shipments are made by courier chosen by Euro Plants Vivai based on the type of packaging provided and the place of destination.

On the day of shipment, an Email will be sent to the Customer containing the tracking code for tracking the shipment (if the courier provides this service). Estimated delivery times may vary from 2 to 3 working days from the date of shipment. They are indicative and could undergo variations due to exceptional atmospheric events, causes of force majeure, traffic conditions or acts of authority. The courier delivers only on weekdays, from Monday to Friday, from 09.00 to 18.00 There is no telephone notice service, however, since these are often heavy packages, in order to facilitate delivery, the courier will always be provided with the full address and all the telephone numbers indicated in the order; however, we cannot guarantee that the courier will always take this into account. If the courier does not find anyone at the indicated address, he will leave a postcard (notice of passage). The Customer can request the (free) return within 3 working days following the first delivery attempt; after this term without any communication from the recipient, the goods will remain in storage at the courier’s warehouse. Furthermore, Euro Plants Vivai does not take responsibility for delays attributable to the courier and can therefore in no case be held responsible. Any delays in deliveries do not entitle the Customer to refuse delivery of the products, nor to claim compensation or compensation of any kind. Upon delivery of the goods, in the presence of the courier, the Customer is required to check that the number of packages corresponds to what is indicated in the Waybill and that the packaging is intact, not damaged or altered, even in the sealing materials ( strings and custom adhesive tape). Any damage or the mismatch in the number of packages must be immediately reported to the courier, adding the wording “accepted subject to inspection of the goods” on the document and confirmed immediately via email (exclusively to info@europlantsvivai.com) to our office.

Attention: if the goods are accepted without adding the necessary wording, it will not be possible in any way to claim, at a later time, any shortages or damage due to transport.
Even if the packaging is intact, the goods must be checked within eight days of receipt.
Any damage or hidden anomalies must be reported in writing via email exclusively to this email address: info@europlantsvivai.com or by registered letter with acknowledgment of receipt to:

6. Tax documentation

The Customer is obliged to provide his data, as follows, for billing:

In the event that the Customer is a company, please also fill in the “non-mandatory” field Company.
In the event that the shipping address does not match the one forwarded for billing, please fill in the mandatory fields to ship the products to the correct address.
If the Customer is a private individual and wishes to receive an invoice, please forward the tax code in the “Order Notes” field.
If the tax code is not present in the “Order Notes” field, the receipt will be issued.
Any communications for the courier must be noted in the section reserved for the “Order Notes”.
When completing the order, the Customer must declare that he has read and accepted these “Terms and Conditions” in all its parts.
The Customer will receive an Email with the Summary of his Order.
The Customer declares that he has not entered false or fictitious data in the order form and therefore declares that the data entered correspond to his real personal data. Euro Plants Vivai reserves the right to prosecute any violation or abuse in the appropriate forums.
If the buyer is a company, the goods will be accompanied by the Transport Document and the invoice will then be sent to the address entered in the registry.

7. Right of Withdrawal

7.1 How to return a Product or an Order

If a Product or an Order does not correspond to Your Requests, Dear Customers may return the Product, the Products or the entire Order within 14 working days from the date of receipt of the Goods, according to Directive 2011/83/EU on Consumer rights.
After the 14-day period of Contract Withdrawal, the returned Products will not be accepted.
All Products must be returned to Euro Plants Vivai in such conditions that they can be put back on sale (Products in perfect condition accompanied by their original Packaging).
Reimbursement of Products Purchased with a Discount will amount to the Price of the Products less the Discount applied.
We invite our Dear Customers preferably using the same packaging in which it was delivered.
If this is not possible, we ask you to pack the Product, the Products or the entire Order carefully to avoid any problems during the return process.
The transport costs for sending the return are the responsibility of the Dear Customer.
Only in the event that the Dear Customer has paid the Transport Costs in the Online Purchase on https://europlantsvivai.com or http://piantedafrutta.com, Euro Plants Vivai undertakes to pay the Shipping Costs for the Return .
Before proceeding with sending the Return, the Dear Customer must complete and send the Return Request.
Euro Plants Vivai invites the Dear Customers to attach an Image of the Product, the Products or the entire Order to the Return Request.
Upon receipt of the Return Request, the Dear Customer will be contacted by the Customer Service to organize the return shipment.

The refund will be paid within a maximum of 14 days from the date of receipt of the Return Request, following the Purchase Payment Method.
Euro Plants Vivai avails itself of the Right to Verify the integrity of the Goods before proceeding with the Refund.
If the Return does not meet the conditions listed, the package will be sent back to you and the Refund will not be made.

8. Warranty

8.1 Secure Website

8.2 Potted plants and fruit trees

Potted Fruit Trees and Plants can be planted all year round, 12 months out of 12.

8.3 Rooting of Plants

Since the engraftment of plants depends on many factors, including concomitant ones, such as care at the time of arrival, soil preparation, planting and appropriate cultivation operations in the period immediately following planting, as well as on climatic conditions and weather conditions of the place where the plantation is carried out, such taking root is not guaranteed by Euro Plants Vivai.

9. Responsibility

9.1 Disruptions due to force majeure

Euro Plants Vivai assumes no responsibility for disservices attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events which prevent, in whole or in part, the execution on time agreed to the contract.
Euro Plants Vivai will not be liable to any party or third party for damages, losses and costs incurred as a result of the non-execution of the contract for the reasons mentioned above, the consumer having the right only to a refund of the price paid.

9.2 Fraudulent use

Euro Plants Vivai is not responsible for any fraudulent or illegal use that may be made by third parties of credit cards, checks and other means of payment, upon payment of the purchased products.
At no time during the purchase procedure is Euro Plants Vivai able to know the purchaser’s credit card number which, via a secure connection, is transmitted directly to the banking service manager.

10. Limits of Liability
